Immigrant Investor Program (EB-5)
This visa is for people and their families (spouses and children under the age of 21) with the ability to obtain a U.S. visa based solely upon a minimum investment in a for-profit enterprise that creates or retains a specified number of jobs. The investor and their dependents will be granted conditional permanent residence valid for two years once their petition of investment is approved.
Eligibility candidates are :
- Must invest of US$800,0000 in Targeted Employment Area (High Unemployment or Rural Area) or US$1,050,000 in other areas
- Must create or preserving at least 10 jobs for U.S. workers excluding the investor and their immediate family
E-2 Treaty Investors
The E-2 nonimmigrant classification allows a national of a treaty country to be admitted to The United States when investing a substantial amount of capital (at least 50% ownership) in a United States business. A substantial amount of capital is referring to substantial in relationship to the total cost of either purchasing an established enterprise or establishing a new one, sufficient to ensure the treaty investor’s financial commitment to the successful operation of the enterprise, of a magnitude to support the likelihood that the treaty investor will successfully develop and direct the enterprise.
The E-2 investor visa is allowed a maximum initial stay of two years. Request for extension may be granted in increments of up to two years each and there is no limitation for the request. Spouse and unmarried children under 21 years old are allowed to accompany and apply as a dependent under the E-2 investor visa holder. If their application is approved, they will generally be granted the same period of stay as the E-2 investor visa holder. Spouses of E-2 visa holders may apply for work authorization by filing Form I-765 with a fee. If approved, there is no restriction as to where the spouse may work.
B-1 Temporary Business Visa /B-2 Tourism Visa
Temporary Business Visa (B-1) and Tourism Visa (B-2) are given to foreign visitors who wish to enter the United States. Interviews are generally required for visa applicants. Examples of activities permitted for B-1:
- Consult with business associates
- Attend a scientific, educational, professional, or business convention or conference
- Settle an estate
- Negotiate a contract
Examples of activities permitted for B-2 :
- Tourism
- Vacation (holiday)
- Visit with friends or relatives
- Medical treatment
- Participation in social events hosted by fraternal, social, or service organizations
- Participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating
- Enrollment in a short recreational course of study, not for credit toward a degree (for example, a two-day cooking class while on vacation)
Documents required to apply for a B-1/B-2 Visa are :
- Passport that is valid for at least six months
- Nonimmigrant visa application (Form DS-160 confirmation page)
- Application fee payment receipt, and photo
F-1 Student Visa
The F-1 Student Visa allows foreign students to enter the United States as full-time students in the country. Foreign students must be enrolled in a program or course of study that culminates in a degree, diploma, or certificate and the school must be authorized by the United States government to accept international students. Holders of the F-1 Student Visa are not able to work off-campus during their first academic year, but may accept on-campus employment subject to certain conditions and restrictions. After their first academic year, they may engage in three types of off-campus employment as Curricular Practical Training (CPT), Optional Practical Training (OPT), Science, Technology, Engineering, and Mathematics (STEM) Optional Practical Training Extension (OPT).
Diversity Immigrant Visa Lottery Program
Each year, only 50,000 immigrant visas are awarded to foreigners to immigrate to the United States. Even if you have applied for a green card through another avenue, you can still consider applying for the lottery. The visas will be given to foreign nationals of countries that have low rates of immigration to the United States an opportunity to participate in a random drawing for the potential of getting an immigration visa.
In order to be eligible for the Diversity Immigrant Visa Lottery Program, you must be a foreign citizen from a country with a low immigration rate to the United States. Each year, the U.S. Department of State puts out a list of eligible and ineligible countries. The list of countries may change each year. In addition, you must have graduated from high school or its equivalent or have qualifying work experience.
